GENERAL RELEASE
SINCE ALL SURFING IS DANGEROUS WE REQUIRE ALL PATICIPANTS TO ASSUME ALL RISKS BY SIGNING THIS GENERAL RELEASE
In consideration of being permitted to participate in the ROXY T STREET
Surfing Contest (“Contest”), I personally and for all of my personal representatives, assigns, heirs and next of kin:
Hereby Release, Waive, Discharge and Convenant Not to Sue Allan Seymour Productions Inc., Quiksilver Inc., Roxy, the City of San Clemente, it’s officers, directors, agents, members, employees, other Contest competitors, Contest sponsors, and Contest judges (hereinafter “Releasees”) from all liability to the Undersigned, whether caused by the negligence of Releasees or otherwise while the Undersigned is participating in the Contest.
Hereby Agree to Indemnify and Save and Hold Harmless Allan Seymour Productions Inc., Quiksilver Inc., Roxy, the City of San Clemente, it’s officers, directors, agents, members, employees, Contest sponsors, and Contest judges from any loss, liability, damage, or cost they must incur due to the presence of any action of the Undersigned in or about the Contest and whether caused by the negligence of the Releasees or otherwise.
The Undersigned expressly agrees that the forgoing Release, Waiver and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agree that the balance shall, notwithstanding, have full legal force and effect.
The Undersigned is fully aware of the risks and hazards inherent in surfing and in participating in surfing competitions and hereby elects voluntarily to enter the Contest, knowing the present conditions and knowing that said conditions may become more hazardous and dangerous during the time the Undersigned is participating in the Contest. The Undersigned herby voluntarily assumes all risks of loss, any damage, or injury that may be sustained by him/her, and any damage to any property of the Undersigned while a participant in the Contest.
I HAVE READ AND VOLUNTARILY SIGN THIS RELEASE, AND WAIVER OF ALL LIABILITY AND INDEMNITY AGREEMENT.
